Terms of Use

Welcome to Dan Micciche Studio. These Terms of Use ("Terms") govern your access to and use of studio.danmiccichemusic.com and the Dan Micciche Studio mobile app (together, the "Portal") and the coaching services offered by Dan Micciche Studio, operated by Hit It Productions ("the Studio," "we," "us"). By creating an account or using the Portal, you agree to these Terms.

Your account

You are responsible for the accuracy of the information you provide and for activity that occurs under your account. The Portal uses passwordless sign-in. You sign in with a one-time code sent to your mobile number, or by email code where we do not have a number for you. Keep access to your phone and your email secure, and notify us promptly of any unauthorized use.

Notifications

With your account you are enrolled by default in notifications about your coaching — session recaps, Fast Feedback deliveries, scheduling reminders, and similar service messages — delivered by push notification and by email. These are on by default. You can turn push notifications off at any time in the app (Profile → Notifications) or in your device settings; email updates can be managed by contacting us. Turning notifications off does not affect your access to the services.

Text Message Program Terms

By providing your mobile number and checking the consent box on our intake form, you agree to receive a one-time automated text message from Dan Micciche Studio (Hit It Productions Inc) with a link to download the studio app. Clients who sign in to the app by phone will also receive one-time verification codes per sign-in request. Consent is not a condition of purchasing any goods or services. Message and data rates may apply; message frequency is described at opt-in. Reply STOP to cancel at any time (you may receive a single confirmation of your opt-out) and HELP for assistance, or contact hello@danmiccichemusic.com. Carriers are not liable for delayed or undelivered messages.

Coaching services and scheduling

Coaching sessions and Fast Feedback are provided by Dan Micciche Studio. Session availability, formats (in person in New York City, in person in Connecticut, or virtual), and scheduling are managed through the Portal and our scheduling provider. You agree to provide accurate materials and to attend or cancel sessions in accordance with the studio's cancellation policy communicated to you.

Payment and refunds

Prices are as stated at the time of purchase and vary by coach and session format. The current price for a session is shown to you when you book it and again when you authorize card-on-file billing; Fast Feedback, studio membership, and other products are priced as listed. Cancellation and refund terms (including any applicable cancellation window) are those communicated to you at booking or purchase. Fast Feedback purchases are fulfilled by delivering a recorded response; please reach out with any concerns about a delivered item.

All payments to the Studio are processed by Stripe. This covers session billing, studio membership, and Fast Feedback, whether you buy on the web or in our app. Fast Feedback purchases made before September 2026 were processed by Square; records of those purchases are retained as described in our Privacy Policy.

Payment always takes place on Stripe's own secure payment pages, in your browser, and never inside our app. When you begin a purchase we send you to your payment profile on that platform, where you can pay with a card you have saved with us or add a new one. Before your first payment goes through you are asked to agree to these Terms on that page, and your agreement is recorded by Stripe alongside the payment itself.

Session billing and payment authorization

When you add a payment card to your account, you authorize Dan Micciche Studio to automatically charge that card for each session you have scheduled. Charges are made approximately 24 hours before a session's scheduled start time, which coincides with the cancellation cutoff described in our Cancellation Policy. Sessions that are not cancelled before that 24-hour cutoff are charged in full, and you remain responsible for the charge whether or not you attend.

This authorization is ongoing: automatic charges recur for each booked session until you remove your card or delete your account. If a charge fails, we may cancel or hold the affected session, and you remain responsible for any outstanding balance. Charges made after the 24-hour cutoff are nonrefundable, subject to the case-by-case consideration described in the Cancellation Policy. We may change our pricing with reasonable notice. Your authorization is recorded with a version and timestamp at the moment you check the authorization box while adding a card.

How your card is handled

The Studio does not store your card details. Cards are collected and stored solely by Stripe, a third-party PCI-DSS-compliant payment processor. Your details go straight to Stripe. We hold only the fact that a card exists, never the number: a customer reference, the card's brand and last four digits as Stripe reports them, and the date on which you authorized billing.

Nothing in our app or on this site ever asks you for a card number, and no payment is taken inside our app. If you pay with a card that is different from the one you have saved with us, that card is used for that purchase only. It does not replace your card on file and does not change what your sessions or your membership are billed to. You change your card on file from My Profile.

You can update or remove your card at any time from My Profile. Removing a card stops future automatic charges but does not waive charges already incurred. Because your card is held by the third-party processor rather than by the Studio, you are responsible for removing your saved card: deleting your Studio account removes the data the Studio holds, and you should confirm that your card has been removed through your profile and, where applicable, with the processor.

Studio membership

Studio membership is an optional subscription that keeps your session recaps, your rep book, your exercises, and everything else the app holds for you open and available. It is separate from paying for lessons. Membership is not required to book, attend, or pay for a coaching session.

Your first lesson starts a free period of 14 days. No card is required to begin it. We tell you the day it starts, what happens at the end of it, and the price, before it runs out. If you do not become a member, your lessons and your materials are not deleted; the parts of the app that hold them stop opening until you join.

Membership is $99 per year or $9.99 per month, charged when you join and then automatically on each renewal date at the same price, until you cancel. The plan and the price you are agreeing to are shown on the screen where you agree, and your agreement is recorded with a version and a timestamp at that moment.

The card you use for membership is the same card we use for your sessions. If you already have a card on file for session billing, joining does not ask you for a new one, and the card you add when you join becomes your card on file. That card is charged automatically for each session you have booked, approximately 24 hours before it starts, exactly as described in "Session billing and payment authorization" above. Nothing about membership changes that authorization, and nothing about it charges you for a lesson you have not booked.

You may cancel at any time from your membership screen or from our secure payment platform. Cancelling stops the next renewal. It does not end the period you have already paid for: you keep everything until that period ends, and the date is shown to you. We do not refund a period that has already begun, except at our discretion.

If a renewal payment fails, we let you know by email and in the app, and your access continues for three days while you update your card. If it is not resolved in that time, membership access pauses until a payment succeeds. Your lessons, recordings, and materials are not deleted.

We may change membership pricing with reasonable notice before it takes effect. A price change never applies to a period you have already paid for.

Recordings and intellectual property

Lessons may be recorded to produce your transcripts, recaps, and analysis. Recordings, transcripts, summaries, Fast Feedback videos, and other materials we create are provided for your personal use in connection with your coaching. The Studio retains ownership of its coaching materials, methods, and content; you retain ownership of materials you submit (such as your headshot, resume, and performance videos) and grant us permission to use them as needed to provide the services. You agree not to redistribute or publicly share studio-created materials without permission.

Acceptable use

You agree to use the Portal only for its intended purpose and not to misuse it, attempt to access other users' data, disrupt its operation, or use it unlawfully.

Disclaimers

Coaching is provided to support your artistic development; we do not guarantee specific outcomes such as castings, bookings, or auditions results. The Portal is provided "as is" without warranties of any kind to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Dan Micciche Studio and Hit It Productions will not be liable for indirect, incidental, or consequential damages arising from your use of the Portal or services. Our total liability for any claim will not exceed the amount you paid for the service giving rise to the claim.

Changes

We may update these Terms from time to time. Continued use of the Portal after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
